GENERAL TERMS AND CONDITIONS FOR THE PARKS OF CROATIA WEBSHOP

General information

Aiming to ensure more effective management of protected areas, the PARCS Project the PARCS Project has been implemented during the period 2014-2017 by the Ministry of Environment and Energy and the United Nations Development Programme (UNDP), in partnership with public institutions (national parks and nature parks), with funding provided by the Global Environment Fund (GEF).

PARCS Project implementation includes the introduction of the PARKS OF CROATIA webshop – a service for online purchase of entry tickets for national parks and nature parks (hereinafter: Parks) in Republic of Croatia. The webshop service is provided via the website at the domain: https://parkovihrvatske.hr/webshop (hereinafter: Website). The service consists of the provision of information services, content management and execution of financial transactions.

Introductory provisions

These General Terms and Conditions of use of the Website (hereinafter: Terms and Conditions) prescribe the conditions and rules for End Users (hereinafter: Users or User). By using the Website, Users accept these Terms and Conditions and agree to use the Website in accordance with them. The right to use the Website is a personal right of the User and it cannot be transferred to another natural person or legal entity in any manner, nor is any User permitted to register other natural persons or legal entities.

The prices are stated in kunas (HRK) and include VAT, and these prices are valid for all methods of payment at the moment of purchase. Prices on the Website may also be shown in several other currencies, but the amount calculated in these currencies is provided solely for information purposes.

Legal disputes that may arise as a consequence of using this Website are under the exclusive jurisdiction of the Court in Zagreb (unless defined otherwise by a special contract), and such disputes shall be resolved in accordance with the laws and regulations of the Republic of Croatia. By using this Website, the User accepts to submit any dispute or request arising out of or in connection with these Terms and Conditions to the exclusive jurisdiction of the Court in Zagreb.

The User agrees and accepts that access to the Website may occasionally be interrupted, temporarily unavailable or switched off due to routine maintenance of the Website or due to other reasons for which the provider of service is not responsible.

The User may submit his/her questions, comments and complaints in written form (by post or e-mail), and the provider of service shall send a written reply (by post or e-mail) within the timeframe prescribed by law.

Acceptance of the Terms and Conditions

By using the Website or by using any part of the content or services of the Website, the User confirms that he/she is acquainted with and in agreement with these Terms and Conditions and with all other rules and conditions of use of the Website and of the services provided via the Website.

If the User does not agree with these Terms and Conditions or if the User is under the age of 14, the User is required to stop using the Website and the services provided via the Website.

Changes and Amendments to the Terms and Conditions and to the Website

The provider of service reserves the right to terminate or change any of the Terms and Conditions stated here, at any point in time and without prior notice, if the provider of service considers it needed. Such changes and amendments to the Terms and Conditions shall enter into force on the date of publication on the Website.

The Users are therefore advised to reread the information contained in the Terms and Conditions from time to time, in order to remain informed on such changes and amendments. Continuation of use of the Website or continuation of use of any part of its content or services after the publication of new changed and amended Terms and Conditions represents acceptance by the User of such changes and amendments.

The provider of service reserves the right to change, amend or eliminate any segment of business operations, which includes the Website and any part, services, specific sections or provided services of the Website, at any point in time and without prior notice. This right includes, but is not limited to, changes to the time of availability of the Website, content, availability of new data, method of transmission and right to access or use the Website. The provider of service has the right to control the content of the Website at any moment, in order to ensure fulfillment of these Terms and Conditions and of laws and regulations.

Liability

User of the Website assumes full responsibility for using the Website.

The User is personally responsible for maintaining the confidentiality of passwords where they exist. The User is acquainted with the fact that services are occasionally interrupted and that events outside of control of the provider of service sometimes occur, and the User accepts that the provider of service is not responsible for any loss of data that may arise during the transmission of information over the Internet.

Under no circumstances shall the provider of service be liable for any damage that may arise out of use of the Website or due to the impossibility of its use or for any damage to the equipment of the User that may arise out of use of the Website.

The User is responsible for the procurement and maintenance of one's own computer equipment, including all software and hardware possessed and used by the User, and for all other equipment needed for access to and use of this Website and for all connected costs. The responsibility of the User includes any damage or possible injury caused by any error, exclusion, interruption, deletion, malfunction, delay in operation or transmission, computer virus, communication line interruption, theft, destruction or unauthorized access, changes or abuse of recordings, inappropriate behavior, negligence or by any other action.

In addition to the conditions stated above, the provider of service shall not be liable, regardless of the cause or duration, for any error, omission or other shortcomings, inappropriateness or unoriginality of the information contained on this Website, or for any delay or interruption in the transmission of information to the User, nor shall the provider of service be liable for any claims or losses stemming from that. Neither of the parties stated above shall be liable for any claims or losses of third parties, including lost revenue.

The user agrees to compensate and to not hold the provider of service liable for any request for compensation of damages and costs, including the costs of legal representation that may arise out of the use of this Website by the User.

Users must not use the Website to publish or transmit any material that endangers or violates the rights of others in any manner; any material that is illegal, threatening, insulting or slanderous; any material that threatens or violates privacy; any material that is vulgar, obscene or otherwise undesirable in reasonable communication; any material promoting illegal activities; any material violating any regulation in another manner; or any material that contains advertising or offer of anyone's products or services without the explicit prior written permission of the provider of service.

The User must not use this Website for the purposes of advertising or performing any commercial, religious, political or non-commercial promotion.

The User expressly confirms that the terms and conditions of this chapter pertain to the entire content of the Website.

Copyright

The Website is private property of Ministry of Economy and Sustainable Development. Any mutual communication and interaction taking place via this Website must be done in accordance with these Terms and Conditions.

All materials contained in this Website represent the exclusive right of the provider of service or are used with the approval of proprietors of copyright and proprietors of trademark and/or design.

Any copying, distribution, transmission, publication, linking or changing of this Website in any manner without the express written permission of the provider of service is strictly prohibited!

Violation of these Terms and Conditions may result in litigation procedure and/or criminal prosecution against the perpetrator due to violation of copyright, trademark or any other form of intellectual property rights.

User registration - User account

In order to use specific content and services of the Website, the User must sign into the system by using an e-mail address, password or other data to be entered in the procedure of User registration.

In the procedure of User registration and opening of the User account, the provider of service will collect certain personal data of the User that are subject to User personal data protection.

The User must state correct, complete and valid data in the process of registration and data entering for the personal profile. In the process of registration, it is not permitted to use names, nicknames and titles owned by third parties or data that are illegal, harmful, threatening, abusive, disturbing, slandering or in any manner harmful to children and minors.

One single natural person or legal entity must not register two or more user accounts. In case of violation of these rules, the provider of service has the right to deactivate or delete User account. By activating the user account, the User assumes full responsibility for all activities undertaken by its use on the Website.

The provider of service reserves the right to reject the registration and to terminate or deny the possibility of further use of User account for which the User is registered, without stating the reasons why User account was terminated or denied to the User.

Protection of personal data and security

The provider of service undertakes not to abuse personal data of the User.

Personal data are all data determining the identity of the User (e.g. name and surname; e-mail address; address of residence; etc.).

The provider of service undertakes to provide protection to personal data of the User by collecting only the basic data about the User necessary to fulfill the obligations. All personal data of the User are strictly protected and are transferred by using the SSL (Secure Socket Layer) protocol, and they therefore cannot be used by third parties.

The provider of service shall not deliver or reveal personal data of the User to a third party, except in cases where that is expressly prescribed by law and in cases where that is required to fulfill the obligations. In case of changes of any personal data recorded during the registration (e.g. place of residence; address of delivery), the User has the duty to enter the changed personal data on the Website. In case that the User does not record changed personal data on the Website, the provider of service shall not be responsible for any shortcomings in terms of orders or delivery.

Data automatically recorded in access to the website which are not personal data (browser type; number of visits; time spent on webpage; etc.) may be used by the provider of service solely for the purposes of assessing the visits to the Website and for the purposes of improving its content and functionality.

Cookies are information stored on the User's computer serving to provide better functionality of the Website. In standard preferences, User computer accepts cookies, and if the User wishes to turn cookies off, options such as quick one-click selection or personalized front page will no longer be available to the User.

The provider of service does not use cookies to store personal data, and privacy of the User is therefore guaranteed.

The provider of service shall use User's e-mail address only for the procedure of ordering and payment on the Website.

Provisions regarding the protection of personal data stated above pertain solely to the Website from these Terms and Conditions.

Types and methods of payment

Ordering and purchase of entry tickets

In order to order and purchase entry tickets by using this Website, the User goes through the following steps:

1. Choosing the type and quantity of entry tickets for a selected Park or several Parks;

2. User registration (sign in);

3. Submitting the order (verification of all data, final control, acceptance of Terms and Conditions, etc.);

4. Confirmation of receipt of the order by the provider of service;

5. Payment – selection of the method of payment and entry of data required for payment (Corvus Pay);

6. Confirmation of payment (Corvus Pay);

7. Confirmation of purchase and creation of invoice for the performed purchase (the provider of distribution and payment service).

All questions and complaints in connection with the use of purchased entry tickets (opening times, attractions, events, etc.) can be submitted directly to the Park Visitor Service and/or the official website of the Park for which the entry ticket is bought.
